“User” refers to any individual who accesses, downloads, registers on, or uses the App, website, or any associated digital platform or service provided by the PinkTree Foundation, including patients, caregivers, healthcare professionals, or general visitors.

“Content” means all text, images, graphics, videos, data, information, and other materials available on the PinkTree App, website, or other PinkTree digital properties. It also includes educational materials, health awareness articles, screening information, event updates, and any user-generated submissions shared through the platform.
1.3 Donor:
“Donor” refers to any individual, organization, or entity that contributes funds, resources, or support to the PinkTree Foundation through its website, app, campaigns, or partner initiatives, either as a one-time or recurring contribution.
1.4 App:
“App” refers to the PinkTree mobile application and its related digital platforms, owned and operated by the PinkTree Foundation, which provide users with access to lung health education, air quality data, screening tools, awareness events, and other related services.
1.5 Resource:
“Resource” refers to any informational or educational material made available by the PinkTree Foundation, including research articles, awareness content, digital toolkits, downloadable materials, partner resources, and other publicly accessible or registered-user content on the App or website.
2. Consent
By using the platform, providing us with your Personal Information or by making use of the features/services provided by the platform, by donating on the platform you hereby provide your consent to the collection, storage, processing, disclosing and transfer of personal information in accordance with the provision of this Privacy Policy and you accept that you have read the Terms of Use. The User acknowledges that he is providing personal information out of his free will. Further, an option to withdraw the consent is to be provided in lines with Digital Personal Data Protection Act, 2023.

8.1 Service Providers
When we engage a Service Provider to perform certain business-related functions, we only provide them with the information that they need to perform their specific function. We may also share your information with any of our partner companies/ entities, subsidiaries, or other companies/ entities under common control with us or not.
8.2 Business Transfers
We may share your information with business partners, or buy or sell businesses or assets. In the event of a corporate sale, asset sale, merger, reorganization, dissolution or similar event, Personal Information and Non-Personal Information may be part of the assets that are transferred.
8.3 Aggregated Information
We may aggregate Personal Information and Non-Personal Information and provide it to our existing or potential business partners, sponsors, advertisers or other third parties, in response to a government request, or to other third parties for lawful purposes. PinkTree Foundation may disclose Personal Information to third party marketers (who may combine such Personal Information with their own records, and records available from other sources), for their own direct marketing purposes, and the direct marketing purposes of other third-party marketers.
We also put in place adequate measures and requirements with our Service Providers, Business Partners, Third-Parties, etc., with respect to data protection and confidentiality of the information of the Users.
9. Security and Data Retention
We take reasonable steps to secure personal data against loss, misuse, or unauthorized access. Information is stored securely and deleted or de-identified when no longer needed, except as required by law.
PinkTree Foundation takes reasonable precautions to safeguard your Personal Information against unauthorized access or disclosure by implementing industry-standard processes and technologies. Sensitive data like payment details/ location etc, are encrypted using technologies/ processes including but not limited to Secure Sockets Layer (SSL), AES256, TLS1.2 & SHA256. Unfortunately, no data transmission over the Internet or stored on a server can be guaranteed to be 100% secure. As a result, we cannot guarantee or warrant the security of any information you disclose or transmit to us online, and PinkTree Foundation is not responsible for the theft, destruction, or inadvertent disclosure of your Personal Information or other information due to any reason such as hacking, cyber-crime, surveillance by third-parties or any force majeure events like natural disaster, man-made disasters, fire, explosion, acts of God, strikes, lockouts, riots, war, etc.
PinkTree Foundation shall retain such information of the User for as long as it is necessary in order to facilitate use of Website/App and for ancillary legitimate and essential business purpose like for improving the website/app, our services, etc and thereafter Pink Tree Foundation shall continue to retain information for such period as it deems necessary and required to retain under any provisions of applicable laws. Your information will be stored in electronic form through third party services in compliance with applicable laws pertaining to data storage.
10. Your Rights

We aim to resolve all complaints promptly, usually within 30 days.
This Privacy Policy will be subject exclusively to the Laws of India. In the event of any dispute arising between the Pink Tree Foundation and the User, then Parties agree to resolve the dispute through amicable settlement. If the dispute is not resolved within 30 (Thirty) days of any party initiating amicable settlement, then it shall be resolved through Arbitration with an arbitration bench seated in Mumbai, with the presence of a sole Arbitrator which shall be selected by PinkTree foundation and the costs shall be borne by each party involved. The court of Mumbai shall have the sole jurisdiction in this matter.
12. Updates to This Policy
Pink tree foundation reserves all the rights to amend/ remove any part of this Privacy policy without notice or liability to any third party. In the event of any significant changes in the privacy policy, the same would be amended under the privacy policy section of the PinkTree foundation. PinkTree foundation may take reasonable efforts but are under no obligation to send the change notice to the User through email. If the User has an objection to the amended privacy policy and no longer wishes to use the platform then such User shall contact PinkTree foundation. Unless stated otherwise our current privacy policy applies to all information that the pink tree foundation has about you and your account collected directly or indirectly. Using the Website/App after a notice of change has been sent to you or published on our Website/ App shall constitute your consent to the changed terms.
13. Refund Policy
All donations and payment collected through website/app are subject to taxation and other applicable laws of India. Any donations or payments made to PinkTree Foundation are non-refundable . Donation and payment are to be paid to PinkTree foundation through third party gateway. When the user clicks on the payment gateway link the user will be redirected to the payment gateway website and in an event of transaction failure and the amount is deducted then such amount shall be refunded in accordance to the refund policy of the third-party payment gateway website. the user is advised to carefully read such refund policy.
